Media reports create the impression that local government
elections cannot take place on 1 November if the Western Cape
application in the Constitutional Court were to succeed next week.

This is not the case. In essence, the case concerns the legality
of two proclamations amending the Local Government Transition Act.

A negative judgement may also affect other such proclamations,
but the transition act, itself is not involved.

Procedures are in any event available to prevent or correct any
disturbing effect on the legal framework for the holding of the
elections.
